Minnesota Controlled Substance Crimes

Minnesota refers to drug charges as Controlled Substance Crimes. These charges may involve an allegation of possession, manufacturing, trafficking, buying or selling an illegal controlled substance. Drug crimes can involve illegal drugs such as heroin, cocaine, methamphetamine and marijuana. They also may involve prescription drugs that are not prescribed to the user. The classifications and punishments for drug crimes include:

  • First Degree Controlled Substance Crime – punishable by up to 30 years in prison and a fine up to one million dollars, or both.
  • Second Degree Controlled Substance Crime – punishable by up to 25 years in prison and a fine up to $500,000, or both.
  • Third Degree Controlled Substance Crime – punishable by up to 20 years in prison and a fine up to $250,000, or both.
  • Fourth Degree Controlled Substance Crime – punishable by up to 15 years in prison and a fine up to $100,000, or both.
  • Fifth Degree Controlled Substance Crime – punishable by up to 5 years in prison and a fine up to $10,000, or both.
  • Gross Misdemeanor Controlled Substance Crime – It is a gross misdemeanor (1) if the amount possessed, other than heroin, is less than 0.25 grams or one dosage unit or less, or (2) the controlled substance is heroin and the amount possessed is less than 0.05 grams.
